Overview
Adjustment of status under INA § 245 allows eligible applicants to apply for lawful permanent residence from within the United States by filing Form I-485, generally without leaving the country for consular processing.
The basic requirements come from INA § 245(a). Generally, an applicant must have been inspected and admitted or paroled, have a visa immediately available in the applicable category, and be admissible. How you entered the United States can determine whether adjustment of status is available.
Immediate relatives of U.S. citizens may have important exceptions. In many cases, they can adjust despite certain visa overstays or status violations. Most other applicants face additional restrictions under INA § 245(c).
An adjustment packet involves more than Form I-485. Depending on the case, applicants may need supporting documents such as Form I-693, the medical examination and vaccination record, and Form I-864, Affidavit of Support, for applicable family-based cases. Filing fees and payment procedures should be confirmed against current USCIS requirements before filing.
Discretion can matter. Adjustment of status may involve discretionary considerations, making it important to present evidence of favorable factors and address potential concerns as part of the application.
Dallas-area applicants generally complete biometrics at a USCIS Application Support Center. When an interview is required, it may be scheduled at the USCIS Dallas Field Office in Irving.
Certain applicants have special adjustment pathways. Asylees and refugees may be eligible to adjust under INA § 209 after meeting the applicable requirements. Section 245(i) may also provide a path for certain individuals who are grandfathered based on qualifying petitions or labor certifications filed on or before April 30, 2001.
A delayed I-485 does not necessarily mean there is no legal remedy. When a case has remained pending well beyond normal processing times, a federal mandamus lawsuit may, in appropriate circumstances, seek to compel USCIS to make a decision. A mandamus action seeks a decision, not a guaranteed approval.
International travel while an I-485 is pending requires careful planning. In many circumstances, departing the United States without advance parole can result in abandonment of the adjustment application under 8 C.F.R. § 245.2(a)(4)(ii), subject to limited exceptions. Applicants should address travel plans with an immigration attorney before leaving the country.
